Students’ employment rights

International students have the same rights as all New Zealand workers.

The same minimum rights and obligations that apply to all workers and employers apply to international students. They can’t be asked to agree to less.

If you employ international student workers you must:

  • Give them a written employment agreement
  • Pay them no less than the minimum wage
  • Give them breaks
  • Give them the holidays and leave they’re entitled to.

Information about employing migrant workers is available on Immigration New Zealand’s website.

To help you put together a draft employment agreement for your worker, use the Ministry of Business, Innovation and Employment’s handy employment agreement builder.

This tool contains clauses that you must include in an agreement, as well as clauses that are optional.
